1. About Castodia
Castodia provides software designed to assist health and social care organisations with care records, operational workflows, management oversight and related activities.
- Castodia is not a care provider or healthcare professional.
- Castodia is not an emergency service.
- Castodia is not a substitute for professional judgement or an organisation’s legal, regulatory and safeguarding responsibilities.
2. Authorised use
You may access Castodia only where authorised. You must:
- Use your own account and keep credentials secure.
- Use information only for legitimate, authorised purposes.
- Follow your organisation’s policies and instructions.
- Respect confidentiality and report suspected unauthorised access or security incidents promptly.
3. Prohibited use
- Share credentials or access information you are not authorised to view.
- Bypass permissions or security controls.
- Disrupt Castodia, introduce malicious software or test security without written permission.
- Unlawfully copy, export or disclose information.
- Use Castodia fraudulently or unlawfully, or reverse-engineer it except where law permits.
4. Care and clinical responsibility
Castodia may support care delivery, recording, management and decision-making. The care organisation remains responsible for:
- Care decisions, staffing and professional judgement.
- Risk assessment, safeguarding and medication management.
- Legal and regulatory compliance.
- Ensuring information entered into Castodia is appropriate and accurate.
- Considering alerts, prompts and workflows alongside the person’s circumstances and applicable policy.
5. Emergencies
Castodia must not be relied upon as the sole means of obtaining emergency assistance. In immediate danger or a medical emergency, follow your organisation’s emergency procedures and contact the appropriate emergency service.
6. Accuracy of information
Customers and authorised users remain responsible for information they enter. Errors should be corrected through the appropriate workflow, without intentionally creating misleading records.
7. Availability
We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability. Maintenance, outages, third-party failures, security events or events beyond our reasonable control may affect access. Formal commitments for paying organisations are governed by their customer agreement and Service Level Agreement.
8. Intellectual property
Castodia software, branding, design, documentation and associated intellectual property belong to Castodia Ltd or its licensors. Access does not transfer ownership.
9. Customer information
Information uploaded by or for a customer remains subject to that organisation’s rights, responsibilities and contracts. Castodia does not claim ownership of a provider’s care records merely because they are processed through Castodia.
10. Suspension
We may restrict or suspend access where reasonably necessary to protect security, investigate misuse, comply with law, protect people or organisations, respond to a material breach or preserve service integrity.
11. Privacy
Personal information is handled under the Castodia Privacy Policy and, where applicable, agreements between Castodia and the relevant provider.
12. Liability and customer agreements
Nothing in these Terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Castodia is not responsible under these public Terms for indirect or consequential loss. Contractual warranties, service commitments and liability arrangements for paying organisations are governed by their executed customer agreement.
13. Changes, law and contact
We may update these Terms as Castodia develops. These public Terms are governed by the laws of England and Wales, and its courts have jurisdiction subject to any mandatory rights.
